Regular Bail Lawyer in Delhi
Being arrested or taken into custody in a criminal case can be a difficult and uncertain situation. Regular bail is a legal remedy through which an accused person in custody may seek release on bail, subject to the applicable provisions of criminal procedure and any conditions imposed by the court.
Under India’s current criminal law framework, regular bail is primarily governed by the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS). The BNSS replaced the Code of Criminal Procedure, 1973 and came into force on 1 July 2024, with the notified exception relating to Section 106(2).
What Is Regular Bail?
Regular bail generally refers to bail sought by a person who has already been arrested or is in custody in connection with a criminal case. The appropriate court considers the application according to the nature of the alleged offence, the stage of the proceedings and the facts and circumstances of the case.
For a bailable offence, the BNSS contains provisions concerning the release of an accused on bail. For a non-bailable offence, Section 480 of the BNSS sets out circumstances in which a person arrested or detained may be released on bail and the considerations and conditions applicable to such release.
Regular Bail Under BNSS
Section 480 of the BNSS deals with bail in cases involving non-bailable offences. The provision addresses circumstances in which a person accused or suspected of a non-bailable offence has been arrested or detained without warrant or appears before a court other than the High Court or Court of Session.
The High Court and Court of Session have special powers concerning bail under Section 483 of the BNSS. These courts may direct that a person accused of an offence and in custody be released on bail and may impose appropriate conditions where permitted by law.
The nature of the alleged offence is also important. Offences may be defined and punished under the Bharatiya Nyaya Sanhita, 2023, while the procedure concerning arrest, custody and bail is principally governed by the BNSS.
How a Regular Bail Lawyer Can Help
A regular bail application requires careful consideration of the allegations, applicable legal provisions, case records and circumstances surrounding the arrest and investigation.
A criminal defence lawyer may assist with:
• Reviewing the FIR and allegations
• Examining the applicable BNS provisions
• Preparing and filing the bail application
• Presenting relevant facts and legal grounds before the court
• Addressing the prosecution’s objections
• Representing the accused during bail proceedings
• Advising the client regarding conditions attached to bail
Every criminal matter involves different facts and circumstances. The outcome of a bail application depends on the applicable law and judicial assessment of the particular case.
