Anticipatory Bail Lawyer in Delhi
Facing the possibility of arrest in a criminal case can be a serious and uncertain situation. Anticipatory bail is an important legal remedy available to a person who has reason to believe that they may be arrested for an alleged non-bailable offence. Under the current criminal procedure framework, anticipatory bail is governed by Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS).
What Is Anticipatory Bail?
Anticipatory bail is a direction issued by the High Court or Court of Session providing that, if the applicant is subsequently arrested in connection with the relevant accusation, they may be released on bail subject to the terms of the court’s order.
Section 482 of the BNSS applies where a person has reason to believe that they may be arrested on an accusation of committing a non-bailable offence. The court considers the application and may grant appropriate protection based on the facts and circumstances of the case.
Anticipatory Bail Under BNSS Section 482
Section 482 of the BNSS replaced the earlier Section 438 of the Code of Criminal Procedure, 1973 (CrPC) for the corresponding remedy. The provision came into force with the BNSS on 1 July 2024.
When granting anticipatory bail, the High Court or Court of Session may impose conditions considered appropriate in the circumstances. These can include requiring the applicant to remain available for police interrogation, preventing any inducement or threat to persons acquainted with the facts of the case, and restricting travel outside India without prior permission of the court.
Section 482 also specifically excludes cases involving accusations under Section 65 and Section 70(2) of the Bharatiya Nyaya Sanhita, 2023 from its application.
How a Criminal Lawyer Can Assist
An anticipatory bail application requires careful consideration of the allegations, applicable provisions, case circumstances and available material. A criminal defence lawyer can assist with preparing the application, presenting the relevant facts before the court and addressing the legal issues arising from the apprehended arrest.
The circumstances may differ considerably from one criminal case to another. Allegations under the Bharatiya Nyaya Sanhita, 2023, the stage of investigation, the nature of the alleged offence and the circumstances surrounding the apprehension of arrest may all be relevant to the legal strategy.
Why Seek Legal Assistance for Anticipatory Bail?
Timely legal advice can help a person understand the applicable provisions and the procedural options available in a criminal matter. Professional representation may be particularly important where there is an immediate apprehension of arrest or where criminal proceedings are already underway.
